360 DEGREES - TERMS & CONDITIONS

 

Acceptance of Orders

All contracts of service or sale made by 360 Degrees complete maintenance & Project Management Ltd (“360 Degrees”) shall be deemed to incorporate these terms and conditions which shall prevail over any other document or communication from the party with whom 360 Degrees is dealing (“The Customer”) All orders and contracts are accepted and fulfilled subject to these conditions under Irish Law unless otherwise agreed in writing.

Any quotation given by 360 Degrees is not an offer to sell.
An order placed by any customer pursuant to a quotation is not binding on 360 Degrees unless and until accepted by 360 Degrees.

 

Prices

All prices are quoted in Euro (and may or may not be inclusive of VAT).

With relation to goods, prices are exclusive of postage and packing, unless otherwise stated.

Delivery where appropriate, will be charged at the current rate.

Call out charges where appropriate will be charged at the current rate.
Maintenance of prices is not guaranteed, and they are subject to alteration without notice.

 

Invoices

Goods and services are charged at the prices ruling at the time of dispatch and provision.
VAT where applicable will be applied to all goods or services supplied at the rate in force at the time of invoice.

Whilst every effort will be made to provide the service or to dispatch the goods on time, no liability can be accepted by 360 Degrees for failure to deliver in the specified time.
All delivery lead times quoted are business estimates only and form no part of any contractual obligation.

360 Degrees will accept no liability for shortages, damage, or non delivery of goods, unless the customer notifies 360 Degrees in writing within two days of receipt of goods or invoice.

360 Degrees liability for the safety of any goods ceases upon 360 Degrees placing the goods under the control and direction of the carrier.

 

Payment

All goods must be paid for in full prior to dispatch. All services provided must be paid for upon immediate completion of the work. An Administration charge of 20 Euro will be applied for unpaid cheques.

 

Title

Ownership of any goods shall remain with 360 Degrees until payment in full has been received. Until such payment has been made, 360 Degrees may at any time (and with out prejudice to any of its other rights) recover or resell the goods or any part of them.
The customer may not resell the goods to which the seller retains title unless agreed by 360 Degrees

 

Specifications

Technical data, dimensions and weights etc., quoted are a guide only and no guarantee is given or implied that the goods will conform in absolute detail to the descriptions and illustrations.
360 Degrees reserves the right to amend specifications and to withdraw goods and services without prior notice.

 

Suitability

Other than expressly stated in the web-site or company catalogue, 360 Degrees makes no representations as to the suitability of any goods or services for any purpose whatsoever.

 

Liability

360 Degrees shall under no circumstances whatsoever be liable for any indirect or consequential loss howsoever caused. 360 Degrees’s liability for any non- performance of any order shall be limited to the value of the goods to which the claim relates.

 

Claims

Non-delivery or damage must be notified to 360 Degrees within three days. Inspection of goods and workmanship upon delivery prior to signing acceptance is essential. Carriers’ notes for delivery of goods must be endorsed accordingly.

Note: Failure to observe the proper claims’ procedure will invalidate 360 Degrees contractual liability under these conditions of sale.

 

Returns

Undamaged, unopened and fully marketable goods may be returned by prior agreement of 360 Degrees, who reserve the right to make a cancellation or administrative charge.

 

Cancellation

Once lodged with 360 Degrees, an order may not be cancelled or delivery delayed without 360 Degrees prior agreement, such agreement must be in writing and then only on the terms incorporated in such agreement.
In all cases the customer shall pay 360 Degrees for all costs associated with work undertaken in relation to the contract and also pay 360 Degrees an amount equivalent to the profits, that 360 Degrees would have achieved, had the contract been completed.
360 Degrees calculation of such an amount shall be binding on the purchaser.

 

Default

The Customer agrees that should collection and/or legal action be taken by 360 Degrees for the recovery of any moneys due and payable by the customer to 360 Degrees, the customer hereby agrees to be responsible for, and to reimburse 360 Degrees for all costs and expenses, including commissions, which may be incurred or become payable in any collection and/or legal action taken for recovery of moneys due and owing.
In this regard costs include legal costs on solicitor-client basis.

 

Fitness for Purpose

The Purchaser agrees that it does not rely on the skill or judgements of 360 Degrees in relation to the suitability of any goods or services for a particular purpose unless it has indicated that purpose in writing to 360 Degrees and 360 Degrees has acknowledged that the goods will be fit for that purpose.

 

Privacy

The Purchaser agrees that 360 Degrees may use your personal information for its legitimate functions including promotions.
360 Degrees will not disclose your personal information except as required to perform our functions or if required to do so by any state or territory law.

 

Disputes

In the event of any dispute between the parties arising out of supply of the goods or services by 360 Degrees to the customer, either party may give written notice of the existence of such dispute to the other whereupon both parties shall attempt to resolve the dispute in good faith.
The parties shall consider using Assisted Dispute Resolution procedures in any attempt to resolve the dispute.
Failing resolution of the dispute, either party may refer the matter to arbitration or to a court of competent jurisdiction.

 

Claims

All discrepancies or shortages must be notified in writing within 2 days of delivery. Claims in regards to invoices must be made within 7 days of the invoice date.

Warranty:
For three months from the date of invoice, 360 degrees will repair any defects in workmanship as from the date of the signed invoice.
This guarantee becomes effective only if the goods or services have been paid for in full and monies credited to our account. This guarantee is for labour only. Materials are not included.

All new components excluding batteries are supplied with a 6 month warranty in regards to faulty materials from date of purchase.

 

Planning

It is entirely the customer’s obligation to check the relevant planning requirements and the subsequent suitability of the building(s) that they are purchasing. No claim will be accepted against 360 Degrees in this respect.

 

Statutory Rights

These terms do not affect your statutory rights as a consumer under Irish or EU Law.
